Layoffs and Bumping Rights
We have negotiated regional layoff protection in the past. Should layoffs occur, we will take action to find another PSA position of equal stature within a given region. AFSCME CANNOT block you from taking ANY vacant state position. We don't want you to demote, we want to keep you at the supervisory status you have earned. We will fight for your right to keep your status as a PSA.
Contract Negotiations and Representation
AFSCME is claiming that they will have the ability to put or roll you into their current contract with the State of Illinois. SEIU and the Laborers’ think this would be a huge conflict of interest and be a disadvantage to all Public Service Administrators. As stated before, PSAs need their OWN contract that addresses the issues important to them.
The current contract in place with AFSCME addresses the issues important to your subordinates and other “rank and file” employees in Illinois. You, as a PSA, will take a back seat in this contract and the issues important to you could be overlooked.
Conflicts of Interest
Another major conflict that could arise is in the case of a grievance. As a PSA you may or may not supervise numerous employees within your department. If AFSCME is successful in putting PSAs into their current agreement (which we do not see happening), you might be faced with the situation where your own union representative will be representing the employee filing a grievance on you as a supervisor. In this situation, WHO WILL REPRESENT YOU?
As two unions who do not have an interest in your subordinates, LIUNA and SEIU will represent you in an unbiased manner, focusing on the facts and what is important to you as a supervisor, not on what is important to the employee filing the grievance.
Please read over this information and call a SEIU or LIUNA representative at (217)522-5158 with any questions you may have. Forming a union within your workplace can often be confusing and complicated, LIUNA and SEIU just want your decision to be based on the facts and not rumors and false promises!
• RUMOR: “PSA’s will not only retain their seniority , but get credit for all their time under the Governor’s jurisdiction."
• FACT: This may be true after negotiations, but AFSCME cannot state it as a fact. Under contract negotiations, EVERYTHING is negotiable, NOTHING can be promised. AFSCME is overstepping their boundaries by stating this as a fact or promise.
• RUMOR: “Pay increases will be negotiated and will be retroactive to the date of certification. Across the board increases already negotiated in our contract will be automatic.”
• FACT: Again nothing can be promised until the contract is signed. First, the administration has to allow PSAs to be covered by the current agreement, then they have to agree to retroactivity. AFSCME is misleading all PSAs by making these statements. They could end up being true, but right now they are false promises.
• NOTE: All promises made by AFSCME like wage increases, seniority, bumping rights, etc. are misleading and have to be mutually agreed to by the current administration and ILRB.
